  • We use third-party payment processors, and you agree to their terms and conditions as well. We are not responsible for any issues arising from the payment processing.

4. Cancellation and Refunds

5. Tour Participation

  • You are responsible for arriving at the designated meeting point on time for your Tour.
  • You agree to follow the instructions and guidelines provided by the Tour Guide.
  • We reserve the right to refuse participation to anyone who is deemed to be under the influence of alcohol or drugs, or whose behavior is disruptive or poses a risk to themselves or others.
  • You are responsible for your own safety and belongings during the Tour.
  • Certain Tours may have physical requirements, and it is your responsibility to ensure that you are fit and able to participate. Please check the Tour details for any specific requirements or recommendations.
  • We may take photographs or videos during Tours, which may be used for promotional purposes. By participating in a Tour, you consent to the use of your image in such materials, unless you explicitly inform the Tour Guide otherwise.

6. Intellectual Property

  • All Content on the Website, including but not limited to text, images, logos, and trademarks, is our property or the property of our licensors and is protected by copyright and other intellectual property laws.  
  • You may not reproduce, modify, distribute, or otherwise use any Content from the Website without our prior written consent.  

7. User-Generated Content (Reviews and Feedback)

By submitting reviews, testimonials, comments, ratings, and any multimedia content (including text, images, videos, etc.) through our Website or in response to review requests, you acknowledge and agree that such content will be considered User-Generated Content (UGC).

  • Grant of License: You retain ownership of your User-Generated Content. However, by submitting any content for review, you grant Historyteller a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, publish, perform, and otherwise exploit your User-Generated Content in connection with the Website, the promotion of Historyteller Tours, and in any and all media formats and channels now known or hereafter devised, without compensation to you. This includes, but is not limited to, use on our Website, social media channels, marketing materials, and other promotional activities.
  • Your Representations and Warranties: You represent and warrant that:
    • You own or have the necessary licenses, rights, consents, and permissions to publish and to grant Historyteller the license to your User-Generated Content as described herein.
    • Your User-Generated Content does not infringe, misappropriate, or violate a third party’s patent, copyright, trademark, trade secret, moral rights, or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
    • Your User-Generated Content is not defamatory, obscene, pornographic, hateful, or otherwise offensive or unlawful.
  • Content Moderation: We reserve the right, but are not obligated, to monitor, review, edit, remove, or refuse any User-Generated Content at our sole discretion, for any reason and without notice.
  • No Obligation: We are not obligated to use any User-Generated Content you submit.

8. Disclaimer of Warranties

  • The Website and its Content are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.  
  • We do not warrant that the Website will be error-free, secure, or continuously available.  
  • We make reasonable efforts to ensure the accuracy of Tour information, but we do not guarantee that all information is complete, accurate, or up-to-date.

9. Limitation of Liability

  • Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.  

10. Indemnification

  • You agree to indemnify, defend, and hold us harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms, your use of the Website, or your participation in a Tour.  

11. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Portugal.  
  • Any dispute arising out of or relating to these Terms or your use of the Website or Tours shall be subject to the exclusive jurisdiction of the courts located in Portugal.

12. Entire Agreement

  • These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding your use of the Website and the booking and participation in Tours, and supersede all prior or contemporaneous communications and proposals, whether oral or written.

13. Severability

  • If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
